20th Street NW/NE IMPROVEMENTS sap no. 249-594-001 BYRON, MN 2022 ADVERTISEMENT FOR SUBMISSIONS Public notice is hereby given that online electronic submissions will be received by the City of Byron, MN until 2:00 p.m. on June 21, 2022 for submission materials. Furnishings and labor for the construction of 20th Street NW/NE Improvements as described in the plans and specifications thereof currently filed in the City Administrator’s office. Proposals will be opened at 2:00 p.m. Proposals will be considered by City Council at a meeting to be held at City Hall, beginning at 6:00 p.m. on June 28, 2022, or at such later time and place as may then be determined. The scope of work involved provides all labor and materials for the construction of the 20th Street NW/NE improvements and related subsidiary and incidental works, including: Granular borrowing 7,768 tonnes Asphalt surfacing 10,427 LF Concrete Curb and Gutter 176 LF 10′ x 8′ Precast Concrete Culvert Method of construction shall be by contract and all work shall be carried out in strict accordance with plans and specifications prepared by WHKS & Co., 2905 South Broadway, Rochester, Minnesota 55904 which have thus far been approved by the City Council and are now filed for public review at the Office of the Acting City Administrator. Contract documents are available at www.questcdn.com. This contract bears the QuestCDN eBidDoc project number 8201258. A contractor may view the contract documents free of charge before deciding to become a plan holder. To be considered a plan holder for submissions, a contractor must register with QuestCDN.com and purchase the contract documents digitally for $20.00. Enrollment as a Plan Holder is recommended for all Prime Contractors and Subcontractors, as Plan Holders will automatically receive notice of addenda and other contract document updates via QuestCDN. For this project, submissions will ONLY be received and accepted through the online electronic submission service via QuestCDN.com. To access the electronic submission form, upload the project documents and click on the submit online button at the top of the submission announcement page. Prospective bidders must be listed as plan holders through QuestCDN for bids to be accepted. Each bid must be accompanied by an electronic copy of a certified check, cashier’s check or bid bond payable to the City of Byron, Minnesota in the amount of at least 5% of the total offer as a guarantee that the tenderer will provide the required bonds. and enter into a contract within ten (10) business days, excluding Saturdays, Sundays and statutory holidays, after contract award. This electronic copy will be facilitated by the Quest CDN electronic auction service. The apparently lowest bidder shall submit a hard copy of the certified cheque, cashier’s check or bid bond within three (3) days of bid opening. Bidders will not be permitted to withdraw their bids for a period of thirty (30) days after their opening. Payment for said 20th Street NW/NE improvements will be made in cash from cash on hand, government grants or any other funds that may be lawfully used for such purposes. Monthly estimates will be made by the Engineer and payment will be made to the Contractor of ninety-five percent (95%) of said estimate. Final payment of amounts due will be made in cash no later than sixty (60) days after substantial completion. For the construction, reconstruction or improvement of streets and highways, including bridges, “substantial completion” shall be defined as the date that construction-related traffic features and ongoing inspections are no more needed. The contractor must commence work after the issuance of the notice to proceed and must complete all items no later than July 31, 2023. The successful bidder will be required to provide a performance and maintenance bond and a payment bond , in an amount equal to one hundred (100)% of the contract price. Said sureties shall be issued by a responsible surety, acceptable to the municipal council, and who will guarantee the proper execution of the contract and the terms and conditions contained therein, and will guarantee the prompt payment of all materials and labor and protect and save and indemnify the City against claims and damages of any kind caused by the operations of the Contractor. This bond will also guarantee the maintenance of the improvements made for a period of two (2) years from its completion and its acceptance by the City. This project is funded in part by state grants and is therefore subject to certain labor standards and civil rights requirements included in the contract documents. Contractors performing work on the project must comply with the requirements listed in applicable laws. Minimum wage rates payable for laborers and mechanics have been determined by the Department of Labor and are listed in contract documents. The contractor(s) will be required to comply with wage and labor requirements and pay minimum wage in accordance with the schedule of wage rates. The plans and specifications governing the construction of the proposed improvements have been prepared by WHKS & Co., Engineers, Planners and Surveyors, Rochester, Minnesota, whose plans and specifications and previous City Council proceedings referring to and defining said proposed improvements are by this is a part of this notice and the proposed contract by reference, and the proposed contract shall be performed in accordance therewith. Copies of said plans and specifications are now on file at the Acting Municipal Administrator’s Office, City Hall, Byron, MN, for review by bidders. Bid forms, plans and specifications can be downloaded for a $20 fee from www.questcdn.com. All bidders will be charged $30 to submit a bid.
