Both the PSOE and the UP have shown this over the course of the year that the negotiations lasted to bring it to a successful conclusion and that the rivalry was evident even after the agreement and approval of the Council of Ministers.

Thus, while the Minister of Transport, Mobility and the Urban Agenda, Rachel Sanchez, reported on the standard at the press conference after Tuesday’s meeting, the Minister of Social Rights, Ione Belarra, he counter-scheduled the appearance by posting a video on Twitter in which he claimed, among other things, his share of responsibility in the future law.

The regulations permanently protect the public social housing stock, which cannot be alienated. In addition, it introduces the notion of affordable housing incentive private property, which gives “tax or other benefits” to landlords who offer a rental at a reduced price.

To mobilize housing and avoid empty floors, the project establishes increases of up to 150% to the IBI in the cash payment. In this way, the currently allowed 50% range is opened up to 150%. This maximum surcharge will be applied to dwellings unoccupied for more than two years and to owners with a minimum of four dwellings in the same municipality.

Minister Sanchez insisted on the fact that the housing bill “makes it possible to reconcile the interests of tenants but also of owners”, since it also offers tax advantages to small owners, those who own less than ten dwellings.

In this sense, the Government intends to stimulate fiscally the rental of residential housing in an affordable manner with deductions ranging from 50% to 90% to the Personal Income Tax (IRPF).

In stressed areas where landlords lower their rent by 5% compared to the previous contract, the bonus will rise to 90%. The deduction will be 70% if you rent for the first time to young people between 18 and 35 years old in these stressed areas. If any rehabilitation or improvement work has been done on the property, the discount will be 60%.

Likewise, owners who sign a contract of at least 10 years will be able to lift the price freeze in stressed areas and will be able to increase the rent. up to 10% in exchange for an extension of the contract period. In addition, in these areas the tenant can extend their contract for three more years than is currently envisaged, keeping the same conditions, thus ensuring that the rent alone increases with the CPI for a longer period.

Local governments will be responsible for defining the declaration of stressed areas, eg.for a period of three years, although it can be extended from year to year if the circumstances arise. Declaring a stressed area will involve articulating a “specific plan to guide actions and reverse imbalances”. It also provides for an exceptional mechanism to contain and lower prices in these areas.

However, there is a 18-month moratorium from the approval of the law until the benchmark price index rules in stressed areas, because, according to the minister, it is a “complex” system that requires to analyze each specific area and, therefore, to do so with “rigor” takes time, although he added that these 18 months is a “maximum” period.

The project will also require reserve 30% of urbanized land for protected habitat, but “the corresponding compensations will be granted when the acquired rights are affected”. Of this percentage, it is possible that half will go to social rent.

The Executive intends to expand the social housing stock, currently limited to some 290,000 housing units, with coverage of 1.6% of inhabitants, against 10% in neighboring countries.
